I think it might work for her. If she was just wandering around without anyone's knowledge then it would likely be just her fault. But since they were aware that she wanted an ice bath and that going through the training room was the only way she could get there, then leaving the room pitch black with a slippery floor maybe wasn't the best way of looking out for her safety.Yeah. That will work against her. She chose to walk through a darkened room already shut down for the day rather than go find someone.

You wouldn't be saying that if you fell, incurred a serious injury and were unable to earn money for an indefinite period of time. Nothing to do with a litigious society and everything to do with protecting people - from wealthy athletes to ordinary people - against negligence. Eugenie Bouchard filed suit Wednesday in US District Court, a civil action against the US Tennis Association in the wake of her accident in the locker room at the US Open last month.
Two counts of negligence are cited, along with a request for a jury trial.
No specific monetary compensation is mentioned beyond the fact that the amount requested exceeds $75,000 US.
But Bouchard's attorneys are asking for actual, compensatory and statutory damages, punitive damages "as allowed by law", pre and post-judgment interest, injuctive relief, attorneys' fees, taxable costs and "any and all further relief as this court deems just and proper."

Shit happens sometimes, it obviously happend that night.
But of course, the lawsuit might have a simple reason, that is not called cash grabbing: Health insurance refusing to pay the cost for the accident.
IndeedI'm not a fan of her's but I support her 100% in this case. We can not have a Grand Slam event being run in such a haphazard manner resulting in concussion.

Years later, I think, because she continued to suffer from the injuries she got there.I've been saying a while I certainly expected her to sue the USTA. Wasn't expecting it to be filed so quickly. Didn't Lauren Davis's suit not get filed until a year after she was injured?
she didn't turn on a light and used equipment w/o trained staff.I thought the different parties were negotiating a settlement.
I don't know what Genie is seeking as far as damages but one thing should happen as a result of this suit.
Players' health, safety, and security must always be properly provided during tournaments.
For some reason, the USTA failed to do so and Bouchard suffered injury as a result.
This should not have happened and hopefully won't ever happen again.
