The guy that owns that blog is a wall street fraudster and was sued by a woman he sexually harassed and lost 18 million dollars. Morelli Ratner represented her.

One question. Why are you talking like it has been proven it was the negligence of the USTA? Thats what she is claiming for her slip, but we dont know what caused the slip. It could very well be something she did. She wouldnt be the first person to sue someone with inaccurate information. Lets just keep that in mind before we talk like this has been proven

You are putting words in my mouth. The medical staff from the USTA confirmed and put out a statement to the effect of Bouchard's concussion the day after the incident. You can find a lot of this information on the U.S. Open website if it hasn't been removed. However, it's not difficult to piece together a timeline to corroborate the chain of events of that night, what with electronic personnel credentials and security cameras on site; and from broadcast videos of Bouchard's matches and press interviews on and off court. Liability cases are always about negligence. The proof will be shown in the jury trial which may not even happen. Property owners in the U.S. are almost always held liable regardless when an accident occurred on their properties. If you care to google some of these cases - precedents, whether in regards to injury, property, or product liability, the plaintiff almost always won. Most of these cases are settled out of court because the insurance companies know they have to pay. They drag it out in order to get a more favorable settlement than a possible court judgment. If you carry a loan on your property, you must have insurance. Filing a civil lawsuit against an insured is the only way to get an insurance company to act because you cannot sue the insurance company directly. These cases are very common. The backlash against Bouchard mostly come from her usual haters, and people who don't understand U.S. laws, and because she is a more high-profile plaintiff than the average citizen. Bouchard is doing what most of us, if not all of us, will do in the same situation.

so if it happened in america then could i sue them twice?

once for the original incident and then the second time for getting me excited enough thinking about suing them that i tripped over again?

technically they are responsible for both incidents, it sounds like there is no personal accountability for my own care in the USA

Don't you have somewhere else to be stupid?

In all fairness, here are the answers to your burning questions: If you have the time, which you seem to, and the money, which you probably don't, you can sue anyone for anything you like in America. You can file court papers all day if you want to. A lot of prison inmates do just that because time is what they do, just like you.

I've lived in more than one European country and while Europeans love to mock the litigious US culture, if they were to hurt themselves as a result of someone else's negligence to the extent that they couldn't work for an indefinite period of time, most people I've met would definitely sue. And most European laws that I'm aware of would be on their side.

People in this thread either just want to make jokes at a dislikeable player's expense, or still don't understand how serious concussion can be. She didn't just get a bruise on her head, she's been unable to complete a full match for nearly two months and has no idea of the long-term consequences. This injury has ended players' careers before - if that worst case scenario happened to Bouchard, would you still say she shouldn't sue?

And it's all very well to say she should take the necessary precautions when walking into a dark room, but the point is the wet floor, not the darkness (which is only relevant insofar as it prevented her from seeing the wet floor). If there was a prominent warning sign about the wet floor, or if she was told about it, she has much less of a case. It sounds like there wasn't, and that's where the negligence lies.

Thinking that Eww Gee Nie would be able to win US Open is like thinking that Nessie exists.

Many people here noticed her big weight-loss. USTA have another possibility to defend themselves with that.

None of us know how frightening it was and probably still is for Bouchard, not knowing what the future will hold for her health and career
None of us know except you apparently, i think her and her team are just maximising the situation, not for financial gain but for a ready made go to excuse for all future disappointments

aka genie obviously would have been a multi grand slam champion if only they hadnt mopped the floor incorrectly and ruined it

i hope they dont settle out of court and make her work for it, this is what insurance companies do best because they are always getting scammed, the probe should include some very interesting questions that i have about the situation
