NM to criminalize abortions for rape victims.
http://www.huffingtonpost.com/2013/0...n_2541894.html
A Republican lawmaker in New Mexico introduced a bill on Wednesday that would legally require victims of rape to carry their pregnancies to term in order to use the fetus as evidence for a sexual assault trial.
House Bill 206, introduced by state Rep. Cathrynn Brown (R), would charge a rape victim who ended her pregnancy with a third-degree felony for "tampering with evidence."
“Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime," the bill says.
Third-degree felonies in New Mexico carry a sentence of up to three years in prison.
Pat Davis of ProgressNow New Mexico, a progressive nonprofit opposing the bill, called it "blatantly unconstitutional" on Thursday.
“The bill turns victims of rape and incest into felons and forces them to become incubators of evidence for the state,” he said. “According to Republican philosophy, victims who are ‘legitimately raped’ will now have to carry the fetus to term in order to prove their case.“
The bill is unlikely to pass, as Democrats have a majority in both chambers of New Mexico's state legislature.

Re: NM to criminalize abortions for rape victims.
Mrs. Brown has apparently come a bit to her senses (after intense pressure and backlash, that is ):
http://www.nydailynews.com/news/poli...icle-1.1247726
Under pressure, New Mexico Rep. amends bill that would have charged rape victims who had abortions with “tampering with evidence”
One week after Republican lawmakers were advised not to talk about rape, a New Mexico state representative introduced a bill that would have criminalized abortions for rape victims. Facing intense criticism, the bill’s sponsor, Rep. Cathrynn Brown, has now amended the measure.
Facing an outcry over her controversial bill that would have charged rape victims who sought an abortion with “tampering with evidence,” New Mexico State Rep. Cathrynn Brown has offered revisions to the measure.
“House Bill 206 was never intended to punish or criminalize rape victims,” Rep. Brown told New Mexico Telegram. “Its intent is solely to deter rape and cases of incest. The rapist—not the victim—would be charged with tampering of evidence. I am submitting a substitute draft to make the intent of the legislation abundantly clear.”

What?
This lady needs to just cut her losses and ditch the legislation entirely at this point

Re: NM to criminalize abortions for rape victims.
This can't possibly be constitutional.

Re: NM to criminalize abortions for rape victims.
Man, that's really strange.
I guess, for me, it should be the only ocasion that abortion should be legalizated and they criminalize it ?

Re: NM to criminalize abortions for rape victims.
Look, nobody deserves to be raped, but if anybody did... well, this lady would do.
Anyway, it apparently is grossly unlikely to pass, so the thread title is misleading.

So the fetus/baby will be used as just an evidence and what will it become and be used for after that? and who's going to look after it and I believe most rape victims would not want to bear that responsible.

Re: NM to criminalize abortions for rape victims.
No laws criminalising abortion in the US will ever be upheld because they will clearly be unconstitutional, which is why Huffington Post got it wrong. The bill is meant to catch rapists or someone who committed incest that force their victims to have an abortion.
