Drunk Driver Who Killed Queens Boy Could Get Just Two Months In Jail
June 22, 2005

A man charged with drunk driving in an accident that killed an 11-year-old boy and ultimately led to a strengthening of the state's drunk driving laws may serve just two months behind bars.

John Wirta was facing up to a year in prison, but the Daily News reports that a plea deal, expected to be finalized Thursday, would call for Wirta to serve just 60 days in prison, 15 days of community service, and three years probation.

Wirta struck and killed Vasean Alleyne and seriously injured 12-year-old Angel in October, 2004 when he struck them with his van while they were crossing 73rd Avenue and 159th Street in Kew Garden Hills, Queens.

Police said Wirta failed a sobriety test following the accident, but the Queens district attorney's office said there wasn't sufficient evidence to charge him with a felony. Wirta was only charged with a misdemeanor, punishable by up to one year in jail, because of an absence of any aggravating factors, such as speeding or running a red light.

The law has since been changed, but it was the old law that applied to Wirta.

The mothers of both boys pushed aggressively to get state legislators to sign the bill that became known as "Vasean's Law." Under the new law, drunk drivers who kill can be charged with a felony without any evidence of aggravating factors and can face up to seven years in jail.

I know. The outrage level on the board is scary. I think we should all go and sacrifice a few goats to Thor, drink some beers, feast a bit, screw a lot, and generally chill out. :lol:

I actually lived in that area. This is sad but in a way typical. I feel that NYC drivers are the worse in the country but then again I also feel that pedestrians in NYC are the worse in the country as well.
Pedestrians in NYC take advantage of "pedestrians always have a right of the way" too much. In cases it does cost lives. I don't think this is one of those cases.

I've driven in NYC a couple of times with people driving on the wrong side of the road in which they have given me the finger for driving on the right side of the street. :lol:
It's crazy. Something should have been done before and its sad that it might take a lost of life for something to be done. It seems that that has to be the case these days for any law to be changed in America.

LOL.

I can understand the outrage though, I don't really understand the laws on drink driving anywhere though - if this man had been sober and had claimed it was an accident, would he have fared any worse ?

What's so stupid about it, my dear? One knows that when you get into a car drunk you run the risk of killing someone. Doing so anyway and having the already mentioned result is no better than shooting someone.

Let me guess, you drive drunk a lot? Maybe even have killed someone? Defending drunk drivers is pathetic.

you are stupid. the guy confessed. there is nothing jugdemental about wanting someone who kills to go to jail.

unless of course you belive that people who confess to killing should not go to jail.

I think most people agree that if you drive drunk or high and kill someone then you should do many years in prison. How many, i dont know but 4-5 seems like a good minimum. However, I personally dont believe that the perpetrator should serve time with viscious malicious killers and totally evil people. more of a minimum security prison situation.

Thankfully, the parents of the dead child have petitioned New York to change drunk driving laws because of this outrage.


What bothered me even more is that this loser's family said they are "suffering" just as much as the family of Vasean.:rolleyes: :fiery:

This is ridiculous, but cases such as this are needed to point out the flaws within laws. Now the law has been corrected, drivers in future cases alike this one can be charged and convicted 'properly'.
