A 23-year-old Norwegian woman was sentenced to nine months in prison yesterday after she was convicted of raping a man.

The Bergen district court also ordered her to pay 40,000 kroner (£3,340) in compensation, in what the local news media said was the first case of its kind in Norway.

According to court testimony, the January 2004 sexual assault took place when the 31-year-old man, whose name was withheld, fell asleep on a couch in the apartment the woman shared with her boyfriend.

He testified that he had woken up because the woman was performing oral sex on him. She at first denied it, but later changed her story, admitting sexual contact but claiming it was consensual.

The court said a legal amendment from 2000 defines such undesired sexual contact as rape.

The man said the episode left him with insomnia and virtually no interest in sex. He also described it as a breach of trust that had crushed his faith in people. The woman's lawyer told the local news agency NTB that an appeal was likely.

Rape or sexual abuse. If it's not consented too, it's sexual abuse or harassment.

Everyone has the right to say 'no'

Just 9 months? If that had been a man peforming oral sex on a woman he'd be getting 9 YEARS. What a double standard.!

but seriously, the guy woke up.. she stopped... not much happened...
she didn't force him or tie him down or something...
still shouldn't have done it though!
even though 90% of the straight male population would kill for it :p

Oh, horseshit. A male rapist (of a female) is more likely to get off than get 9 years.

Anyways, if the man is having the problems that he claims, then clearly the right verdict was reached. It's not fair to assume that just because he's a male he should be happy to wake up in the midst of a sexual act. Yes, some people are fine with that. He apparently was not, and his rights have to be respected.

But the difference is that the majority of women don't want a sexual contact while they're sleeping and 99% of men would dream to wake up and realize a 23 year old woman give him a blow job (unless they're gay [Blocked Ads] ). How is she supposed to guess he's like, one of the few guy on the planet Earth who would be offended to received a BJ?

I think it's stupid... The guy isn't 12, he's 31. Any sane 31 year old guy would laugh over this and tell that to his friends after. There's probably much to the story such as personal revenge or something.

That's like saying all women who wear short skirts are slags and are gagging for it from any bloke.

Stereotypes are a bad thing which we all use, but should know when you cross the border and this bloke had every right to refuse what she had done.

Personally, If i didn't like her, I would of just shoved her off and if she persisted get my sisters to give her a pasting

Hmm I'd be ok with it if it was my gf (a virtual one lol) who did this to me, but if it was, for instance, a girl from work --> :bigcry:

Ugh all he had to do is to tell her to stop when he woke up. Does he really need to go to court over this?

It's as stupid as people who sue McDonalds because they're fat.

I wouldn't want to wake up and realizing someone gives me a blow job, but I would just tell the person to stop.

So if a woman woke up and a bloke had his tongue on her clit, she'd say 'stop' and that would be it?

Hmmmm, i don't think so neither

No... men can be sexually aroused against their will.

Hmm, I may be an exception, but I'm straight, and I wouldn't want to have sex with anyone willing. It'd be very disturbing for me to find a random girl with her face between my legs when I wake up. It's kinda gross, and also not safe.

BritneySpearsIsHot

Is it what we're talking about, no. Oral sex for men and women are 2 completely different things. I'm not talking about this in legal terms but in term of common sense. If I would be a woman, I wouldn't be afraid one bit to give a BJ to a guy, whether he's drunk, asleep or very awake because I KNOW that he's going to like it.

But wait men are women are the same. There's no difference between men and women. It's an evil stereotype to assume men like to receive BJ. Ok whatever, I'm out of this.

And all the women I know like cunnilingus.......

But like I said, depending on the woman, I'd like it or dislike it.......if I didn't like her, I'd get my sisters to give her a pasting, because I'd have that choice, the same as she had when she decided to get my dick out.

I don't go along with all men and women are the same, so therefore i don't think all men are assholes and all women are slags.........would be very easy to think like you I admit, but I like to make judgements on individuals not a collective..

But would you send a woman in jail 9 months for that?

Depends on the character's of the two people and many other circumstances that you, I, or anyone else cannot tell from a small article as per the first post.

Don't know the whole story but if the man has suffered since and Norwegian law states that this can be classed as rape, then yes.

I wouldn't have gone to the police, I've already said what i'd do, but this guy chose too.

BritneySpearsIsHot
Apr 28th, 2005, 06:29 PM
I think he's being overdramatic and the whole issue is ridiculous. "He also described it as a breach of trust that had crushed his faith in people." Ugh. Sounds like complete bullshit to me.

I don't care Norwegiasn law, or any other law for that matter, and I know that any sane 31 year old man who would wake up and realize a girl gives him a blow job would simply tell her to stop and move on to something else. He probably has issues and use the incident as an excuse to explain his problems.

Possibly so, but still within his rights

Seriously, I can understand the dude feeling a bit violated but he could of got up and told her he was not interested. It was not like she raped him or anything. I don't understand it at all.

Guys for the most part are usually the aggressor's when it comes to sex, so I can understand a female being violated or pressured into having sex and consider that rape. But you have to be a punk bitch if you are going to sue a woman for giving you head, just another frivilous lawsuit.

BritneySpearsIsHot

But my opinion isn't based on his rights, so I don't care about his rights.

Which is fair enough, as long as you accept if anything happens to someone, whether illness, anal rape or anything, then people have the right to call them ridiculous if they feel it is.

We all have different boundaries I guess, and like yourself, for me this is not a police issue, but then I believe in revenge rather than police as usually the police are useless.

Tough world, gotta make your own rules.

People are different though. You get some very gentle men and very aggressive women.

I've learnt over the years, what is okay for one, may not be for another. It's best to be open to everything and from all angles.

Alot of talk is 'general' and about 'average people'

But we all know, not everyone fits in them categories. I've seen some fearful looking women and some dorky looking men.

But like alot say, I wouldn't go to Police, I'd 'sort it' personally......which is what he could have done.

I don't know how would an average guy react in that situation, because I'm, well, not one, but I guess it's possible that he didn't enjoy what was happening.

it's just bs to drag someone to court for this
they were sleepingin the same bed, so he must not have been disgusted by her
and he could have just told her to stop and that'd be the end of it

Well if that is rape then many many many many woman have a case against their husbands or boyfriends. Unfortunately some men feel when you are in a relationship with them they have a right to initiate sex even if your sleeping. This has never happened to me, no really I had a conversation with a boyfriend once and I informed him he did anything to me while I was a sleep he might as well call the police for me. :fiery: However, I've heard it over and over from women that this happens. So no I don't agree that if it was a man he would've gotten 9 years. I do think it's wrong and she got what she deserved.
