Gay pub can bar heterosexuals

A MELBOURNE pub catering for gay men has won the right to refuse entry to heterosexuals in a landmark ruling at the state planning tribunal.

The owners of Collingwood's Peel Hotel applied to ban straight men and women to try to prevent "sexually based insults and violence" towards its gay patrons.

The Victorian Civil and Administrative Tribunal last week granted the pub an exemption to the Equal Opportunity Act, effectively prohibiting entry to non-homosexuals.

VCAT deputy president Cate McKenzie said if heterosexual men and women came into the venue in large groups, their number might be enough to swamp the gay male patrons.

"This would undermine or destroy the atmosphere which the company wishes to create," Ms McKenzie said in her findings.

"Sometimes heterosexual groups and lesbian groups insult and deride and are even physically violent towards the gay male patrons."

Some women even booked hens' nights at the venue using the gay patrons as entertainment, Ms McKenzie said.

"To regard the gay male patrons of the venue as providing an entertainment or spectacle to be stared at, as one would at an animal at a zoo, devalues and dehumanises them," she said.

"(This exemption) seeks to give gay men a space in which they may, without inhibition, meet, socialise and express physical attraction to each other in a non-threatening atmosphere."

The Peel manager Tom McFeely told the tribunal the plan to refuse entry had been advertised at the hotel, with no objections received.

Mr McFeely said most of the regulars at the hotel had responded positively.

A spokeswoman for the Victorian Gay and Lesbian Lobby Group said she believed the ruling made the Peel one of only two men-only venues in Melbourne.

"This exemption was not sought to exclude members of the community but to try to maintain a safe space for men to meet," the spokeswoman said.

She said gay men at the Peel had recently been ostracised and made to feel like "zoo animals".

"It's sad that members of our community would have to go to the VCAT to preserve their rights," the spokeswoman said.

"This is one of the only free venues with live music in the area, so certainly some people may feel a bit unhappy about the decision."

The Peel attracted criticism in April over an ad for a gay Anzac Day party that showed a near-naked man in a slouch hat.

The hotel used a Shrine of Remembrance guard as the unwitting star of an ad for an Anzac Day eve bash. The ad was published in gay magazines and on the venue's website.

It was withdrawn after intense criticism from the Victorian RSL, which called it a "desecration of the Anzac spirit".

I read this in the paper this morning and couldnt believe it.. im bi so im not biased either way but imagine if straight or normal (no offence meant) clubs were to ban gay men ??? there would be riots !!
But i do understand that when ur with a guy it can be uncomfortable to have women or str8 guys watching.. but thats when you go somewhere more private

The report is a little vague.....it says it "effectively" prohibits entry to non gay people. Sounds a little like tabloid fodder to me. I am sure it will get lots of talk back radio discussion time.

How does one decide who is gay and who is not? Do you fill out a questionare at the door?

If I went to the pub with my Dad or brother, would they be denied entry? I think not.

Pubs and clubs in NSW have the right to remove people for offensive conduct etc...and can limit entry to members only. I am unsure of the situation in VICTORIA...I am sure it is the same.

It seems that the pub is more concerned about large groups of non gay patrons...who may not behave themselves.

I am gay, most of my friends are not gay....if I am at a gay venue with them I know they respect the gay patrons.

If groups of people are simply attending the pub to poke fun at other patrons or behave inappropriately then that is indeed a problem.

I'd imagine that the pub would quite happy to have anyone on the premises.....gay or straight or whatever...as long as they behave themselves and respect people.

Any Melbournites out there who could shed some light on this particular pub and the new conditions of entry...as the report lacks any real detail of the decision and how the pub intends to "enforce" such restrictions.

This has been outlawed in the UK now with the introduction of a new law recently brought in to make sure homosexuals aren't discrimiated againts. In turn its meant straight people can't be refused entry to gay clubs/pubs cos their straight. Although i'm sure other reasons will be found.

If this is true, it sounds impossible to police to me.

Which is a good thing because such blanket policies are wrong IMHO.

Yep...absolutely impossible to police on an individual level...and the pub owner is aware of this...this was never the intention.

From the additional information I gathered..the owner says that he will indeed be actively trying to limit the number of non gay patrons....as he expressed concern over large groups of non gay patrons and gay women arriving at the pub.
THE PEEL is marketed as a gay male pub...yet they are having problems with bucks night and hens night groups causing concern for patrons. With a number of threatening situations developing. That said, he noted that everyone is welcome...if they remain aware that the pub is foremost a gay male venue and should be respected as such.

The "new law" allows the owner to turn away large groups..
Pubs and clubs have always had this power though...to reject large groups of people. The difference here is that the label of exclusion is large "heterosexual" groups. As the owner states...non gay people are not going to turned away...but large party groups (hens nights, bucks nights etc) will be.

Whilst I see this "new law" as potentially problematic...and I am not at all a fan of the ruling...there are plently of non gay pubs in and around Melbourne....

I don't see why non gay people would feel a need to congregate there in the first place in large groups. The owner of the pub said that his application to the Civil Rights Authorities in Victoria was made for the safety of the patrons.

Anyway..its a bit of a "storm in a tea cup" really...some cheap story to run for a couple of days as the election lead up bores us all to tears.

Bloody stupid ruling. It reintroduces segregation and non-integration. I hope that gay people will agree that this ruling is unhelpful and discriminatory unles, of course, they want to be segregated and treated differently, in which case they will need in future to be very careful about what they complain about, when it comes to the attitude of society, etc)

That's really, really wrong. In my experience, straight people who go to gay bars/clubs are really nice and (obviously) have no problem with homosexuality. There is only one club near me, and it's a gay one... so a lot of straight people go there, but there are never any problems.

This sort of discrimination should be illegal.
