Beatles Say iTunes Is Bad Apple

Apple Computer Inc. is on the defensive in Europe for the second time in as many weeks as the company prepares to battle The Beatles' record label for its right to distribute music in the United Kingdom's highest court.

Apple will go before a judge in London this week to determine whether iTunes online music violates an agreement the company made with Apple Corps, which claims the service infringes on a15-year-old agreement. It is the third time the company that holds rights to Beatles music has taken Steve Jobs' company to court over its name.

The suit seeks an injunction on Apple's music sales and compensation for past sales. Though some media have reported both talks of a settlement are already in the works, neither company has released a statement on the topic. Representatives from the Apple companies could not be reached Monday.

The British company first sued the computer maker over the Apple name 15 years ago and settled for $80,000 and an agreement the computer company would avoid the music business. Eight years later, the company sued again when Macs became tools for recording and mixing music files. Again, the California company settled with the U.K. company - this time paying more than $25 million and agreeing not to distribute compact discs or other music recordings.

Now, the question is: Does that agreement apply to online music file transfers?

The battle is the second front that opened in Apple's European operations in two weeks. Last week, the lower house of French parliament passed a bill that would require all music files to be interoperable. Apple is fighting that file sharing and copyright protection bill as it makes its way to the French Senate and threatening to pull out of France if the bill becomes law.

i have no idea why apple signed that agreement with apple corps clearly apple ended up losing and how the fuck can someone claim to copyright something like "apple" i dont get it.

beats me? I wonder if they are planning to sue Gweneth and Chris Martin too.

Oh, I didn't know about that bill. That's a good idea I think.

bad idea....

apple WILL pull out of the france market before agreeing to anything of the sort. this is not something that is up for question. i dont even think apple will suffer bad press for it either, the french people must not like the ipod, and apple will save money in trying to translate everything into french...

I don't think we have itunes in Canada (or do we? ) but we manage fine with other online music suppliers. Apple is bluffing anyways.

ah if they are using ipods they have itunes....it's the only way to get music on them as is the case for every other mp3 player the only difference is Apple also sells mp3s.

Man, the only way you can get music on ipod is by downloading it from itunes?! Damn, that's bad. The only question I have is how come everyone tolerates this sort of blatent practice of monopoly so far. Good thing I use Zen player from Creative because could download mp3s/WMAs and other formats from different online music providers.

blah, that makes no sense... that kind of logic would require every maker of every piece of software to support every format and hardware ever. plus its NOT a monopoly you yourself said you have a zen, if it was a monopoly there would be no other choice, but there are choices....

anyway all of this is moot because apple will pull out.

oh you don't need to download from itunes to put songs on your ipod. You just need to transfer songs to itunes first to able to transfer them to your ipod later.

first off Ipod users can download music from any provider but you have to import into itunes before you can put it on your ipod just like the creative zen the only difference is that you can also purchase music using your itunes of which you can't do with the software Creative zen provides. What the French want is the equivalent of asking Windows to make the code for the .wma and windows media player open to any developer so they can use it as they see fit.
